§1 Applicability to entrepreneurs and definitions of terms

(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB).
 

§2 Formation of a contract, storage of the text of the contract

7) Binding dispatch of the order by clicking on the button "order with costs" or "buy"

§3 Prices, shipping costs, payment, due date

(1) The prices indicated include the statutory sales tax and other price components. In addition, there are any shipping costs.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all of the items we offer are ready for immediate dispatch. 

(2) The risk of accidental loss and accidental deterioration of the item sold is only transferred to the buyer when the item is handed over to the buyer, even in the case of mail-order sales.
 

§5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

Consequences of revocation

If you withdraw from this contract, we shall immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.

We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

Payment:
You can choose to pay by credit card or PayPal. The ordered goods will only be produced after full payment has been received and after the right of cancellation has expired.

Delivery:
We ship our goods using logistics companies. The delivery and shipping costs are displayed in the shopping cart. The shipping costs shown here refer to a delivery within Germany, excluding the German islands. We will quote freight costs on islands and abroad on request. If you pick it up yourself, we will inform you by e-mail about the availability of the goods and the pick-up options. In this case, no shipping costs will be charged.

For reasons of sustainability, our products are delivered unpackaged but protected with reusable materials and partly unassembled. The protective materials remain the property of the seller, as they are reused for further transport in order to do even more justice to sustainability. Connections of kitchen sinks, stoves, light strips are the responsibility of the buyer and are not part of maljé's service.

The delivery date will be confirmed by us to the  e-mail address you provided and will be adhered to accordingly. We will inform you in the event of delays in delivery dates. Slight excesses do not entitle to claims for recourse. In the event of delays in delivery, the buyer can withdraw from the order after granting a reasonable grace period of at least 20 working days in writing. Claims for damages from consequential damage are excluded.

As soon as the ordered goods leave our warehouse, the risk passes to the buyer. This also applies if we deliver through a carrier of our choice. The goods must be checked for completeness and visible defects immediately upon receipt. Visible defects must be noted in the bill of lading. After receiving the goods, the buyer is obliged to unpack the goods and examine them for hidden defects. These must be reported in writing within 5 days.

We are entitled to rectify existing defects by rectification or, in the event of failure, to deliver a replacement before the customer can assert further rights. Delivery is only to the buyer's doorstep. Transport to the building or to the apartment in a building is the responsibility of the buyer.

Right of withdrawal:
For the Maljé Living area, a right of withdrawal is only possible within 14 days from the day of the order. The products only go into production after this period has expired, so that the right of withdrawal expires.

Goods return:
In principle, ordered goods cannot be returned.
